Health Risk Assessment

An evaluation or screening of a plan participant's physical health, well-being, and general lifestyle behaviors, often conducted in the context of an employer-sponsored wellness program or health plan open enrollment (see Practice Note, Wellness Programs). A health risk assessment may:
  • Include preventive screenings and measures of an individual's health from year-to-year.
  • Be based on an individual's health-related biometric data, for example, blood pressure and cholesterol levels (see Article, Biometrics Litigation: An Evolving Landscape).
  • Provide the individual specific feedback concerning the assessment's results to promote improved health going forward or support fitness-oriented goals.
An individual's health risk assessment's results (if favorable) also may be the basis for wellness program incentives or rewards, subject to restrictions under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) (see HIPAA Privacy, Security, and Breach Notification Toolkit and Group Health Plans Toolkit). Health risk assessments involving disability-related inquiries or genetic information are subject to restrictions, respectively, under the Americans with Disabilities Act of 1990 (ADA) and the Genetic Information Nondiscrimination Act of 2008 (GINA) (see Practice Note, GINA Compliance for Health and Welfare Plans).
