Jackson Lewis: California Intermediate Appellate Court Reverses Ruling Finding On-call Rest Breaks Violated State Law | Practical Law

This California wage and hour Law Firm Publication by Jackson Lewis P.C. discusses Augustus v. Abm Sec. Servs. In Augustus, an appellate panel of the California Court of Appeal's Second District reversed a district court decision and held that "on call" rest breaks did not violate state law. The Second District noted that although the employer required employee guards to keep their radios on when on break and respond if their services were needed, the employees were free to participate in personal activities and were relieved of many duties that were required of active employees. The court also found that the rest breaks were not subject to the same standards that applied to meal period requirements.
