Landlord Lien Right

A lien on a tenant's personal property for the satisfaction of unpaid rent or property damage in the leased premises. In most states landlord's lien rights are governed by statute. The landlord is given the status of a preferred creditor regarding the tenant's personal property.
A lender often requests landlord lien waivers when its borrower is a tenant that is obtaining financing secured by the tenant's:
  • Leasehold interest.
  • Personal property, such as its equipment.
