A Practice Note discussing how to enforce a subpoena ad testificandum or duces tecum in the New Jersey Superior Court, Law Division, Civil Part or in a non-foreclosure action in the Chancery Division, General Equity Part. This Note explains the first steps to take when a non-party witness disobeys a subpoena that a party serves during pretrial discovery (discovery subpoena) or for trial (trial subpoena) and how to file an application in aid of litigant's rights under N.J. R. 1:10-3 to compel the witness's compliance with the subpoena. It also outlines the procedure for initiating summary criminal contempt proceedings under N.J. R. 1:10-2.
