A Checklist addressing what counsel litigating in the New Jersey Superior Court, Law Division, Civil Part and Chancery Division, General Equity Part generally need to know about how a notary public or notarial officer (notary) performs a remote notarial act using communication technology under the New Jersey Law on Notarial Acts, N.J.S.A. 52:7-10 to N.J.S.A. 52:7-19 (modeled on the Revised Uniform Law on Notarial Acts (2021) (RULONA)). The Checklist explains how the notary verifies the remotely located individual's identity, creates and preserves an audiovisual recording, confirms the record, and executes a certificate of notarial act. It also identifies the requirements for a notary performing a remote notarial act for an individual located outside the US. This Checklist contains an example of how to perform a remote ink notarization (RIN) of an affidavit when the notary does not physically possess the affidavit.
