This Practice Note is an overview of the general features of state Unfair and Deceptive Acts and Practices (UDAP) statutes (sometimes called "Little FTC Acts"), which are in force in all states and the District of Columbia and aim to protect consumers from a variety of unfair and deceptive business practices. General features discussed include the scope of the statutes (including substantive consumer protections and exceptions and state rulemaking authority), public enforcement (including equitable or injunctive relief, restitution, and civil penalties) and consumer enforcement (including compensatory damages, punitive damages, and class action lawsuits). This Note also discusses some of the key differences among state UDAP statutes, using several state UDAP statutes as examples.
