An outline of the law of damages for misrepresentation where the misrepresentation has not become a term of the contract. This note explains the principles that apply when assessing damages for misrepresentation at common law and under the Misrepresentation Act 1967 and highlights the manner in which the assessment differs depending on whether the misrepresentation is fraudulent, negligent or innocent.
