Execution

The meaning of this term depends on its context:
  • In the context of contractual formalities, the way in which a person enters into a document or deed either by sealing it, or by signature, thereby giving it legal effect.
  • In the context of dispute resolution, the "process for enforcing or giving effect to the judgment of the court". The process is "completed when the judgment creditor gets the money or other thing awarded to [them] by the judgment" (Lord Denning in Re Overseas Aviation Engineering GB Ltd [1963] Ch 24).
There are several methods by which a money judgment can be enforced, including Taking control of goods, a Charging order, a Third party debt order and Attachment of earnings. For further information, see CPR 70 and Practice note, Enforcing a money judgment: an overview.
