The Internal Revenue Service has updated the Operational Compliance List for tax-qualified retirement plans. The Operational Compliance List notifies plan sponsors and service providers of changes to the tax-qualification requirements that became effective during the 2021 calendar year.
The IRS has updated the Operational Compliance List for tax-qualified retirement plans. Under IRS Rev. Proc. 2016-37, the Operational Compliance List identifies changes to the tax-qualification requirements for plans that will become effective during the 2021 calendar year. 2021 Operational Compliance List

The updated Operational Compliance List identifies changes to tax-qualification requirements that will take effect in 2021, 2022, or retroactively, including the changes under the Setting Every Community Up for Retirement Enhancement Act (SECURE Act) and Coronavirus Aid, Relief, and Economic Security Act (CARES Act).

Updated Life Expectancy and Distribution Period Tables

The 2021 Operational Compliance List includes the final regulations that update the life expectancy and distribution tables that are used to calculate required minimum distributions (RMDs) (85 Fed. Reg. 72472 (Nov. 12, 2020); see Practice Note, Required Minimum Distributions from Retirement Plans: Proposed Regulations with Updated Life Expectancy and Distribution Period Tables for Determining RMDs). The final rules apply to distribution calendar years beginning on or after January 1, 2022.

Changes Under the SECURE Act

The 2021 Operational Compliance List includes changes under the SECURE Act, including the following (unless otherwise indicated, they are effective in 2020):
The IRS also encouraged plan sponsors to remove plan language that permits loans using credit cards or similar arrangements by the deadline set out in Section 601 of the SECURE Act to avoid an operational failure.

Notices 2020-42 and 2021-03

The Operational Compliance List was updated to include IRS Notice 2020-42 and Notice 2021-03. Notice 2020-42 provided relief from the physical presence requirement for obtaining spousal consents under qualified retirement plans from January 1, 2020, through December 1, 2020. Notice 2021-03 extended this relief through June 30, 2021 (see Legal Update, IRS Notice 2021-03 Provides Temporary Relief From the Physical Presence Requirement for Spousal Consents Through June 2021).

Changes Under the Taxpayer Certainty and Disaster Tax Relief Act

The Taxpayer Certainty and Disaster Tax Relief Act of 2020 (Disaster Tax Relief Act) was enacted as Division EE of the Consolidated Appropriations Act, 2021 (CAA-21) (Pub. L. No. 116-260 (Dec. 27, 2020)); see Legal Update, Year-End COVID-19 Stimulus Legislation Includes Numerous Employee Benefit and Executive Compensation Provisions, Including Surprise Medical Billing Requirements for Health Plans). Three provisions of the Disaster Tax Relief Act are included in the 2021 Operational Compliance List:
  • Under Section 208 of the Disaster Tax Relief Act, certain employees in the building and construction industries who are age 55 or older (rather than age 59 ½ and older) and who are receiving retirement benefits from multiemployer plans are permitted to work and receive such benefits.
  • Under Section 209 of the Disaster Tax Relief Act, plans are not treated as having a partial termination under Internal Revenue Code Section 411(d)(3) (26 U.S.C. § 411(d)(3)) during a plan year that includes the period between March 13, 2020, and March 31, 2021, provided the number of active participants covered by the plan on March 31, 2021, is at least 80% of the number of active participants covered on March 13, 2020.
  • Under Section 302 of the Disaster Tax Relief Act, plans may offer special disaster relief to participants affected by disasters declared between January 1, 2020, and February 25, 2021. This relief includes qualified disaster distributions, suspension of loan repayments, and higher limits for loans. Plan amendments for the disaster relief are due the last day of the first plan year beginning on or after January 1, 2022.

Changes Under the Bipartisan American Miners Act

The 2021 Operational Compliance List includes IRS Notice 2020-68 guidance relating to the Bipartisan American Miners Act. Notice 2020-68 provides Q&A guidance on:
  • Section 104 of the Miners Act, which lowered the age for in-service distributions from retirement plans from 62 to 59.5.
  • The deadline for amending qualified plans, 403(b) plans, governmental 457(b) plans, and IRAs to reflect Section 104 of the Miners Act.

The Operational Compliance List was updated to include the following changes under the CARES Act:

Notice 2020-52

The IRS added Notice 2020-52 to the Operational Compliance List. Notice 2020-52 provides relief regarding mid-year reductions or suspensions of contributions to safe harbor 401(k) and 401(m) plans (see Legal Update, IRS Notice 2020-52 Provides Guidance on Mid-Year Changes to Safe Harbor Plans).

Practical Implications

The Operational Compliance List helps plans remain operationally compliant by identifying changes in qualification requirements effective during the calendar year. It is important for tax-qualified retirement plan sponsors and service providers to be aware of the 2021 updates to the Operational Compliance List.
