Russia (Sanctions) (EU Exit) (Amendment) (No 6) Regulations 2022 (SI 2022/241) entered into force at 5.00 pm on 8 March 2022 and introduce new aircraft and trade sanctions measures in relation to Russia.
The Russia (Sanctions) (EU Exit) (Amendment) (No 6) Regulations 2022 (SI 2022/241) entered into force on 8 March 2022. The regulations, made under the Sanctions and Anti-Money Laundering Act 2018, extend the scope of the Russia (Sanctions) (EU Exit) Regulations 2019 (SI 2019/855) and provide for new aviation and trade sanctions measures in relation to Russia.
The new measures relating to aircraft allow for the termination of an existing registration and the refusal of an application for registration of aircraft owned by designated persons within the UK. It bans aircraft owned, operated or chartered by a designated person or a person connected with Russia as well as aircraft registered in Russia from overflying or landing in the UK and gives the Secretary of State power to direct an airport operator to detain Russian aircraft. The powers in relation to aircraft are extended to apply against any person who possesses the legal title to the aircraft or any share in the aircraft or has a beneficial interest in the aircraft.
The trade sanctions amendments apply existing measures on "restricted goods" and "restricted technology" to aviation and space items thereby preventing their export, supply, delivery, making them available or transfer to or for use in Russia. The prohibition also extends to the provision of related technical assistance, financial service funds or brokering services. Equally importantly, the regulations contain a further prohibition on the provision of insurance and reinsurance services relating to aviation and space goods and technology, to a person connected with Russia, or for use in Russia.
The regulations also correct omissions from the Russia (Sanctions) (EU Exit) (Amendment) (No 4) Regulations 2022 (SI 2022/203) regarding shipping measures.
Also on the 8 March 2022, the Foreign, Commonwealth & Development Office (FCDO) updated its guidance on Russia sanctions, which now includes guidance covering the most recent amendment regulations.
