The tracking list of the Supreme People's Court's interpretations aligned with the Civil Code.
The Civil Code of the PRC 2020 (2020 Civil Code) took effect from 1 January 2021. The code is the first legislation of China (PRC) enacted as a "legal code" (法典). It consolidates a number of civil laws enacted and revised in piecemeal fashion over the last 40 years. Many of China's existing regulations have been reviewed against the norms of the code, and more new ones are to be formed as an on-going legislative project.
On 30 December 2020, the Supreme People's Court (SPC) announced its completion of a comprehensive review of all 591 judicial interpretations and related normative documents then issued since its founding.
The review was initiated in June 2020 to help facilitate the transition to the 2020 Civil Code, and to ensure that the SPC's interpretations and rules are consistent with the new code and with one another.
As a result of the review, the SPC:
- Retained 364 judicial interpretations and related rules without amendment.
- Invalidated 116 judicial interpretations and rules.
- Amended 111 judicial interpretations and rules.
- Issued the first batch of seven new judicial interpretations to support the 2020 Civil Code.
The SPC also reviewed its guiding cases project, initiated in 2011, and determined that two guiding cases (that is, Guiding Case No. 9 and Guiding Case No. 20) would no longer apply. This tracker monitors the progress of SPC interpretations issued, amended or repealed due to the code alignment.
SPC Interpretations: Newly Issued
First Batch of Seven Pieces
The first interpretation in the new batch addresses the timing for the application of the 2020 Civil Code. According to the Legislation Law of the PRC 2023, a new law only has binding force on legal acts that occur after the law is implemented. Hence, the 2020 Civil Code and the new judicial interpretations apply to acts that occur on or after 1 January 2021. Acts that occurred before that date are governed by the laws and judicial interpretations in effect at that time.
The other six interpretations relate to the application of the system for taking security under the 2020 Civil Code, as well as the provisions of the new code related to property rights, marriage and family, inheritance, construction contracts and labor disputes, respectively.

SPC Interpretations: Repealed
Of the 116 judicial interpretations and normative documents that were invalidated, most were revoked because they were outdated, while others were repealed because the substantive issues they address are or soon will be covered by the new code or by valid judicial interpretations or related rules.

National Courts Meeting Minutes
The SPC issues meeting minutes from time to time to guide the people's courts in their trials. Meeting minutes are not judicial interpretations and cannot be cited as the basis for adjudication. However, the people's courts can reason according to the relevant provisions of meeting minutes after they are issued when specifically analysing the reasons for the application of law. Therefore, in fact, meeting minutes may have the same or similar effect as a judicial interpretation in guiding the people's courts at all levels in specific trials. For example:
- On 8 November 2019, the SPC issued the Notice by the SPC on Issuing the Meeting Minutes of the National Court Work Conference for Civil and Commercial Trials 2019 (最高人民法院关于印发《全国法院民商事审判工作会议纪要》的通知), addressing legal issues in several types of civil and commercial disputes. The minutes are commonly referenced as the "Ninth Meeting Minutes" (九民纪要) as it is the meeting output of the Ninth National Civil and Commercial Trial Work Meeting.
- On 6 April 2021, the SPC issued the Notice by the SPC regarding Issuing the Meeting Minutes on the Implementation of the Civil Code by Courts Nationwide 2021 (最高人民法院关于印发《全国法院贯彻实施民法典工作会议纪要》的通知), which, among other things, addresses legal issues in the application of the General Provisions and Contracts Parts of the 2020 Civil Code before the promulgation of relevant judicial interpretations.
