The US Patent and Trademark Office (USPTO) has announced it will begin sending courtesy e-mail reminders to trademark registration owners for upcoming post-registration maintenance filing deadlines.
On October 24, 2014, the US Patent and Trademark Office (USPTO) issued a press release announcing it will begin sending courtesy e-mail reminders of upcoming post-registration maintenance filing deadlines for Section 8 and Section 71 declarations and Section 9 renewals to registration owners who have:
  • Live registrations on the date of sending.
  • Provided a valid e-mail address to the USPTO.
  • Authorized e-mail communication.
The courtesy reminder e-mails will:
  • Be sent on the first day of the statutory filing period for the maintenance filing to all e-mail addresses on record in the Correspondence and Current Owner(s) information fields. Registration owners can use the USPTO's Trademark Electronic Application System (TESS) to verify, update, add or delete their e-mail address information.
  • Identify the registered mark, corresponding serial and registration numbers, the date of registration and the owners of record in the USPTO's trademark database.
  • Identify the maintenance filing currently due with the anniversary filing deadline, the grace period deadline and the filing fee per class.
  • Provide links to the USPTO website for general information on registration maintenance requirements and other trademark databases.
The USPTO will not send either reminders by regular mail or follow-up e-mails to undeliverable addresses. Registration owners or their attorneys who do not wish to receive these courtesy e-mails should delete their e-mail address from the USPTO's trademark database.
Trademark owners are reminded to continue to monitor USPTO maintenance deadlines for their registrations as non-receipt of a USPTO courtesy reminder will not excuse a registration owner who fails to meet its statutory obligations.
