Many previously believed that the patent laws granted immunity from the antitrust laws for restrictions and litigation threats within the scope of a patent. This Article discusses recent developments that indicate that the assertion of patent rights by patent assertion entities, or “patent trolls,” is the next front in the growing battle between the antitrust laws and the patent laws.
