This December Practical Law China has expanded its coverage of the competition topic collection with the publication of Practice note: overview, Chinese anti-unfair competition law.

New content

Competition

The practice note provides an overview of China's revised anti-unfair competition law. It highlights the changes and impacts brought by the revised regime to typical unfair competition acts, that is, commercial bribery, passing off, infringement of trade secrets, false promotion and commercial defamation. It also introduces the regulation of emerging unfair competition infringements involving the internet. The note discusses the enhanced enforcement powers of administrative authorities and the increased civil and administrative liabilities for unfair competition offenders.

Corporate

We have published Article, Environmental protection reforms: a shift to green development for China, in collaboration with Paul Davies, Bridget Reineking and Andrew Westgate of Latham & Watkins.
The article introduces China's changing environmental priorities and policies, and the government's commitment to strengthening environmental protections in China following the 19th National Congress of the Chinese Communist Party in October 2017. The reforms discussed in the article include China's aggressive environmental enforcement actions, the development of pollutant discharge permitting rules and a national emissions trading scheme.
