A Practice Note analyzing the key issues courts consider when determining when and how a party may obtain information about another party's preservation and discovery processes in federal civil litigation. This Note addresses discovery tools that counsel commonly use to request this information (such as interrogatories, requests for the admissions, and depositions) as well as other approaches counsel may take to obtain information about another party's discovery process.
