A collection of resources to assist counsel representing manufacturers, distributors, and marketers of foods, dietary supplements, and cosmetics to identify regulatory and legal issues related to these products and mitigate legal and business risks.
Manufacturers, distributors, and marketers of foods, dietary supplements, and cosmetics must comply with numerous federal and state laws and regulations. The requirements vary depending on the product and the regulatory agency. They cover a range of issues, including:
  • The types of ingredients permitted.
  • The manufacturing and transporting of the product.
  • Required labeling and permissible claims.
  • Facility registration and the submission of certain information to regulatory bodies.
Federal agencies that regulate aspects of one or more of these products include the:
  • US Department of Agriculture (USDA), which ensures the safety of meat, poultry, Siluriformes fish, and certain egg products and has jurisdiction over their labeling.
  • US Food and Drug Administration (FDA), which ensures the safety of dietary supplements, cosmetics, and foods not regulated by the USDA and has primary responsibility over their labeling.
  • Federal Trade Commission (FTC), which has primary responsibility over the advertising of foods (including meat, poultry, and eggs), dietary supplements, and cosmetics.
Some federal agencies regulate in areas that impact foods, dietary supplements, and cosmetics, such as the Consumer Product Safety Commission (CPSC), which enforces the Poison Prevention Packaging Act (PPPA) and requires child-resistant packaging for dietary supplements and cosmetics containing certain ingredients.
This Toolkit is a collection of continuously maintained resources designed to help counsel identify applicable laws and regulations, minimize the risk of legal challenges, and overcome potential regulatory obstacles in the marketing of these products.
