A deed of variation of a lease for use where a tenant wishes to install plant and equipment outside the boundaries of the property demised but there are insufficient rights granted by the lease.

This deed also incorporates the right for the landlord to require the tenant to relocate the plant and equipment.

It is important that the variation comprises the grant of a specific right or easement, rather than the demise of additional land. The standard document should NOT be used to extend the demise, or to substitute property within the demise, as this will amount to a surrender and regrant by operation of law (see Practice note, Deemed surrender and regrant of a lease).
