PD 57AD ("Disclosure in the Business and Property Courts") requires the parties jointly to produce a List of Issues for Disclosure in cases where it is expected that search-based Extended Disclosure (that is, Model C, D or E) will be sought.
This checklist considers the formal requirements and provides some pointers regarding the practicalities of preparing a List of Issues for Disclosure, focusing on cases subject to the "mainstream" procedure under PD 57AD.
PD 57AD took effect on 1 October 2022, replacing what was PD 51U, and implementing, on a permanent basis, the procedures that applied, from 1 January 2019 until 1 October 2022, under the Disclosure Pilot Scheme (PD 51U).
For consideration of the Less Complex Claims regime, which took effect on 1 November 2021 and is now set out in Appendices 5 to 7 of PD 57AD, see Practice note, Disclosure in the B&PCs: Q&A on the Less Complex Claims regime.
