This practice note summarises the relevant statutory provisions, in particular the Intellectual Property (Unjustified Threats) Act 2017, the main provisions of which came into force on 1 October 2017 and which applies to threats made after that date. The note considers the key changes made by the Act, key cases concerning threats to sue for infringement of intellectual property (IP) rights and provides practical advice on how these may affect any IP disputes.
