Right of Publicity

The right of a natural person to control the commercial exploitation of their identity and prevent its unauthorized commercial appropriation by others. Protected aspects of identity can include a person's:
  • Name.
  • Likeness.
  • Voice.
The right of publicity is governed by state law and is not recognized in every state. In those states that do, the scope of protection varies and may be governed by either or both:
  • Right of publicity and privacy statutes.
  • Common law.
Remedies for violations of the right may include either or both:
  • Injunctive relief.
  • Money damages.
