This Checklist provides guidance to providers and their counsel to understand the kinds of gag clauses that are prohibited by the Consolidated Appropriations Act, 2021. The Checklist also provides recommendations on reviewing and negotiating amendments to or new provisions in their managed care contracts that address gag clauses.
