CFI reduces vitamin cartel fines imposed on BASF and Daiichi | Practical Law

On 15 March 2006, the Court of First Instance (CFI) handed down judgments in the appeals by BASF AG and Daiichi Pharmaceutical Co. Limited against the fines imposed on them by the European Commission for participation in cartels in various vitamin markets. The CFI reduced the total fines imposed on BASF from EUR296.16 million to EUR236.845 due to errors by the Commission in finding that BASF was a leader or instigator of the infringement in four vitamin markets and certain misapplication by the Commission of the Leniency Notice. Daiichi's total fines were reduced from EUR23.5 million to EUR18 million as the CFI found that the Commission had underestimated the importance of Daiichi's co-operation under the Leniency Notice.
