A Practice Note providing an overview of the enforceability of releases and waivers of liability (commonly referred to as liability waivers or exculpatory agreements) given by patrons of commercial establishments, such as a retail stores, services facilities, or activity venues, to protect the owner or operator of the commercial establishment against liability for personal injury claims. This Note also provides tips to assist counsel in drafting an enforceable liability waiver.
