One year later, on March 16, 1984, Matthew John Galas, Sr., and Dorothy Galas, Johnnie's parents (“plaintiffs”), filed the instant action under
42 U.S.C. § 1983 on their own behalf and on behalf of their son. As defendants, the Galases named Officer Richard McKee and the Metropolitan Government of Nashville, Davidson County, Tennessee (“the City”). In the complaint it was alleged that Officer McKee's conduct violated Johnnie's rights under the Fourth, Eighth, and Fourteenth Amendments of the United States Constitution. On March 8, 1985, the district court granted defendants' motion for summary judgment.
