This Legal Update reports on significant changes to the local civil and criminal rules and procedures for all US federal district courts and appellate courts between November 2-8, 2016. It also reports on changes to the individual civil and criminal practice rules for the judges in select district courts during this period.

Administrative Office of US Courts

The US Judicial Conference approved inflationary increases to the Miscellaneous Fee Schedules, effective December 1, 2016. Many appellate and district courts have updated their fee schedules accordingly.

District of Columbia Circuit

District of Columbia Circuit Court of Appeals

The US Court of Appeals for the DC Circuit posted a notice regarding amendments to the Federal Rules of Appellate Procedure that take effect on December 1, 2016.

District of the District of Columbia

The US District Court for the District of Columbia amended its local rules. A copy of the previous version is available here.

First Circuit

District of Maine

The US District Court for the District of Maine amended its plan for the random selection of grand and petit jurors.

District of New Hampshire

The US District Court for the District of New Hampshire revised its acknowledgment and waiver of rights form.

District of Rhode Island

Fourth Circuit Court of Appeals

The US Court of Appeals for the Fourth Circuit posted new brief & appendix requirements.

Fifth Circuit

Eastern District of Texas

The US District Court for the Eastern District of Texas posted General Order 16-13 regarding the transfer of Tyler Division criminal case defendants.

Middle District of Louisiana

The US District Court for the Middle District of Louisiana posted General Order 2016-15 regarding equests for relief in light of Johnson vs. United States, 135 S.Ct. 2551 (June 26, 2015).

Seventh Circuit

Northern District of Illinois

The US District Court for the Northern District of Illinois posted General Order 16-0020, regarding electronic case filing. This order supersedes General Order 14-0024.
The US District Court for the Northern District of Illinois amended:
  • Local Rule 5.9 - Service by Electronic Means.
  • Local Rule 26.1 – Scheduling Conference.

Eighth Circuit

Eighth Circuit Court of Appeals

The US Court of Appeals for the Eighth Circuit amended Local Rules 25A(b) and 25A(c), and deleted Local Rules 3B and 33A, effective December 1, 2016.

District of Minnesota

The US District Court for the District of Minnesota revised its civil and criminal ECF procedures guides.

Eastern District of Missouri

The US District Court for the Eastern District of Missouri posted Form MOED-0062 - notice requesting hearing on motion for temporary restraining order.

Ninth Circuit

Ninth Circuit Court of Appeals

The US Court of Appeals for the Ninth Circuit updated its model civil jury instructions and provided a list added or modified jury instructions.

Central District of California

The US District Court for the Central District of California amended its local rules, effective December 1, 2016. A redline of the changes is available here.

The US District Court for the Western District of Washington posted General Order 09-16, regarding mandatory pretrial discovery in pro se prisoner 42 U.S.C. § 1983 cases.

The US District Court for the District of Kansas posted Standing Order 16-02, regarding standard conditions of supervision.

Eleventh Circuit

Middle District of Florida

Magistrate Judge Philip R. Lammens revised his case and trial management preferences.

Southern District of Florida

The US District Court for the Southern District of Florida posted Administrative Order 2016-56 regarding amendments to Local Civil Rules 5.1, 7.1, 11.1, 26.1, and Local Criminal Rule 88.10. The amendments are effective December 1, 2016.
