Speedread

This May, Practical Law China has published a large number of translations. These include Chinese language versions of the core standard documents for China Global M&A and cease and desist letters for IPR infringement. For more information about these series of resources related to China Global M&A and IPR, see Practical Law China bilingual content.
This month, we have published standard clauses setting out the statutory annual leave entitlements that employees have under Chinese employment law, see Standard Clauses, Employee handbook: Annual leave policy.
As usual, we have also published our regular monthly roundup of key items for general counsel, GC Agenda China (see Article, GC Agenda China: May 2016 ) and separate legal updates for important legal and practical developments in the last month (see Legal updates) and have updated a number of materials in the light of the legal and practical developments (see Maintenance).

New content

IP & IT

Most legal drafting found in contracts and legal documents dealing with intellectual property originated in the English language. This can make it difficult for the Chinese-speaking recipients of enforcement letters (such as cease-and-desist letters) to understand, even when translated. To help practitioners parse these, we have published a series of Chinese-language translations of our China IP and IT standard documents drafted to preserve the legal effect of the original, while remaining easy to understand in the Chinese language. These can be found here:

Employment

We have published standard clause, Employee handbook: Annual leave policy . This standard clause sets out the statutory annual leave entitlements that employees have under Chinese employment law and should be included in the employee handbook as a part of various leave entitlement policies.

GC Agenda China: May

The new GC Agenda is now out. GC Agenda China provides practical, specific and actionable advice on key issues for GC covering China. GC Agenda China is also a useful reference point for external counsel who need an overview of the main developments outside their own practice area.
This month's GC Agenda China covers:
  • The foreign NGO Law enacted by the NPC.
  • The NDRC's draft guidelines on monopoly agreement exemptions.
  • SAIC's revised company registration and related rules.
  • The SPC and SPP's interpretation on criminal bribery and corruption cases.
  • The intern management regulations jointly issued by five ministries.
  • The SPC's interpretation on consumer public interest litigation.
  • The SPC's revision to court rules.
