In Credit Suisse International v Stichting Vestia Groep [2014] EWHC 3103 (Comm) (03 October 2014), the High Court considered the enforceability of provisions of the 2002 ISDA Master Agreement where one of the parties had acted outside its capacity by entering into derivative transactions under the agreement.
