Sorted by topic and date, the IP&T Case Trackers provide easy access to recent, significant decisions affecting intellectual property law and Practical Law's legal updates analyzing the key aspects of those decisions.
The IP&T Case Trackers are collections of links to recent decisions that significantly affect the practice of intellectual property law and Practical Law's legal updates covering the key elements of these decisions. The trackers are sorted by topic in reverse chronological order in a table format, making it fast and easy to:
  • Find the most recent cases that significantly affect a particular intellectual property topic.
  • Access the applicable court decision.
  • Access Practical Law's Legal Updates analyzing the important aspects of the decision and providing related practice implications.
Practical Law offers Case Trackers for patent, copyright and trademark law. They include all of the cases that Practical Law Intellectual Property & Technology has reported on since December 2011.

Patent Law

The Patent: Case Tracker currently features more than 200 cases and Legal Updates on more than 50 patent topics and subtopics, including prior art, obviousness, claim construction, patent exhaustion, Hatch-Waxman litigation, ITC Section 337 investigations and remedies.
The USPTO America Invents Act Trial Tracker (PTAB) currently features more than 130 Patent Trial and Appeal Board and US Court of Appeals for the Federal Circuit decisions regarding post-grant patentability proceedings under the America Invents Act, including final written decisions, institution decisions and other interim decisions in inter partes review and covered business method review proceedings.
The Actavis Case Tracker tracks court decisions interpreting the US Supreme Court's decision in FTC v. Actavis, which held that reverse payment settlement agreements (also known as pay for delay agreements) should be analyzed under the rule of reason.

Trademark Law

The Trademark: Case Tracker (Federal) currently features more than 100 significant federal court cases and Legal Updates on more than 40 trademark topics, including, for example, likelihood of confusion, counterfeiting, genericness, functionality, abandonment, licensing and damages.
The Trademark: Case Tracker (TTAB) currently features:
  • More than 70 significant Trademark Trial and Appeal Board (TTAB) decisions and federal decisions on appeal from the TTAB.
  • Legal Updates on more than 20 trademark topics, including, for example, ownership, descriptiveness, cancellation, issue preclusion, procedure and genericness.

Copyright Law

The Copyright: Case Tracker currently features more than 100 significant cases and Legal Updates on more than 35 copyright topics, including joint authorship, substantial similarity, contributory infringement, fair use, licensing, preemption and damages.

Accessing the Case Trackers

Users can access the Case Trackers in the following ways:
  • Directly from the top of the Patents, Trademarks and Copyright topic indexes under the header Practice Note: Overview.
  • By entering "[SUBJECT] case tracker" in the search bar on any page.
Users also should consider adding useful Case Trackers to their My Favorites page, which can be accessed by clicking "My Practical Law" at the top right corner of any page. To do this:
  • Access the applicable Case Tracker page.
  • Click on the "Save" link in the box towards the top right corner of the page.
  • Select the Favorites folder and click "Save."
