Fiduciary duties
Duties owed by a fiduciary to another party, also referred to as fiduciary obligations. Examples of fiduciary duties include a duty to act in good faith, a duty of confidentiality, a duty of no conflict, and a duty not to profit from the fiduciary position. The object of fiduciary duties is to ensure that the position of trust in which the fiduciary is placed is not abused for personal gain. The scope of a fiduciary's duties and obligations will depend on the particular circumstances, including the extent of the undertaking made by the fiduciary and the nature of the activity to which the fiduciary duties relate.
