The Department of Health and Human Services (HHS) issued final regulations that increase Health Insurance Portability and Accountability Act (HIPAA) privacy and security protections for individuals' health and genetic information. The regulations also strengthen breach notification requirements under the Health Information Technology for Economic and Clinical Health (HITECH) Act by clarifying when information breaches must be reported to HHS.
On January 17, 2013, HHS issued final regulations that:
  • Increase HIPAA privacy and security protections for individuals' health and genetic information.
  • Revise breach notification requirements under the Health Information Technology for Economic and Clinical Health (HITECH) Act by clarifying when information breaches must be reported to HHS.
  • Make other changes to HIPAA to streamline individuals' ability to share their health information.
The final regulations, which are based on changes under the HITECH Act and the Genetic Information Nondiscrimination Act (GINA), are effective March 26, 2013. Covered entities and business associates must comply with the regulations by September 23, 2013.
