The Swedish Arbitration Association (SAA) hosted its second bi-annual conference, the Swedish Arbitration Days, in Stockholm on 16 and 17 September 2010. The theme for the conference, which was attended by more than 200 participants from around the world, was damages and other relief in international arbitration.
The conference was conducted as a series of panel debates concerning different topics relating to damages and other relief in international arbitration. The issues were addressed from the different perspectives of the speakers, who came from all over the world and had different experiences of international arbitration. A variety of users of international arbitration provided their views, including lawyers, arbitrators, in-house counsel, financial experts, scholars and accounting experts, as well as two Swedish Supreme Court Justices. Several interesting and thought-provoking debates arose at the conference. For instance, whether arbitrators are able to fully grasp the, often complex, financial theory that lies behind the evaluation of a claim for damages and whether counsel pay sufficient attention to this or have surrendered the issue into the hands of an increasing number of experts. The debates of the panelists also spurred a number of interesting questions and discussions with participants from the audience.
