PLC Arbitration has published Practice note, Arbitration in Switzerland, authored by PD Dr Nathalie Voser (Partner), Dr Christopher Boog (Associate) and James Menz (Associate) of Schellenberg Wittmer (Zurich).
The note considers the framework for domestic and international arbitrations in Switzerland, as set out in:
  • Chapter 12 of the Private International Law Act 1989.
  • The Swiss Code of Civil Procedure.
  • Case law of the Swiss Federal Supreme Court.
The note also describes the most significant features of the arbitral process in Switzerland, from the requirements for a valid arbitration agreement to the duties and powers of the tribunal, and the role of the state courts.
