This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between October 30 and November 5, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Changes in Miscellaneous Fees

The Judicial Conference announced changes to the federal court miscellaneous fee schedules, effective December 1, 2013:
  • The fee for docketing a case in the US Court of Appeals will be increased from $455 to $505, which includes a $500 fee to docket the appeal and a $5 filing fee.
  • The records retrieval fee will be increased from $53 to $64 for the first box requested from a Federal Records Center and there will be a new fee of $39 for each additional box requested.
  • There will be a $53 fee for any payment returned or denied for insufficient funds.

Second Circuit

Eastern District of New York

Northern District of New York

The US District Court for the Northern District of New York posted two new general orders:
  • An order directing the expedited service of the summons and complaint, and directing the completion of a Rule 16 Stipulation for the timely progression of civil actions.
  • An order regarding a pilot mandatory mediation program.

Southern District of New York

Judge Ronnie Abrams posted a new case management plan and scheduling order. A copy of the previous version is available here.

Fifth Circuit

Eastern District of Louisiana

The US District Court for the Eastern District of Louisiana posted a consolidated guide on administrative procedures and unique procedures and practices for electronic case filing. Eastern District of Texas

The US District Court for the Eastern District of Texas posted a new general order adopting a model order focusing patent claims and prior art to reduce costs.

Northern District of Texas

The US District Court for the Northern District of Texas added a short instruction on its civil forms page, noting that the form for Certification of Judgment for Registration in Another District (form AO451) cannot be issued if a motion under Federal Rule of Appellate Procedure 4(a) or an appeal is pending, or if the time to file an appeal has not passed.

Sixth Circuit

Eastern District of Michigan

A new Local Rule 42.1 for the US District Court for the Eastern District of Michigan went into effect on November 1, 2013.

Seventh Circuit

Northern District of Illinois

Judge James F. Holderman posted a new set of model jury instructions for various types of cases.

Eastern District of Wisconsin

The US District Court for the Eastern District of Wisconsin updated its fee schedule:
  • Witness and juror per diem fees in Milwaukee increased from $158 to $165.
  • Witness and juror per diem fees in Green Bay increased from $123 to $129.

District of Minnesota

Central District of California

The US District Court for the Central District of California posted a notice regarding amended local civil, criminal and bankruptcy rules that will go into effect on December 1, 2013.
