This note considers what happens when a party to EAT proceedings wishes to rely on evidence that was before the employment tribunal (for example, by production of the employment judge's notes of evidence), when they wish to rely on evidence that was not before the tribunal and when they wish to raise arguments that were not raised before the tribunal.
