This article examines the application of European competition rules on vertical agreements in the context of online trading. In particular, the article: provides an overview of the current approaches under European competition law, which are consistent in treating online and offline traders equally in many respects; provides a critical analysis of these approaches; outlines alternative approaches; and highlights the need to apply competition law in a way that promotes innovation.
