E.D. Va.: Affidavits Related to Class Certification Motions Must be Based on Personal Knowledge | Practical Law
In an April 8, 2014 decision in Soutter v. Equifax Information Services LLC, the US District Court for the Eastern District of Virginia held that an affidavit submitted in support of, or in opposition to, a motion for class certification must be based on the declarant's personal knowledge for the court to consider it sufficiently reliable.
