Arnold J has considered questions of infringement under Articles 9(1)(a) to 9(1)(c) of the CTM Regulation and passing off in a claim brought by the registered proprietor of the Community trade marks OCH and OCH-ZIFF in relation to the defendants' use of various signs incorporating the terms OCH and Och, in respect of services identical to those covered by their trade mark registrations.
