This Law Firm Publication by Fisher & Phillips LLP discusses the Phase-In Overtime for Agricultural Workers Act of 2016 (AB 1066) recently signed into law by Governor Jerry Brown. The new law, which is union-sponsored, establishes a new Section 857 of the Labor Code. It launches a "phase-in" process for new, more stringent overtime protections applicable to any worker engaged in an agricultural occupation. The phase-in begins January 1, 2019, and culminates January 1, 2022, when workers must be paid double time for all hours worked over 12 in a workday.
