A Checklist identifying steps to consider when assessing whether pre-award security is appropriate to seek when there is a real concern about the counterparty satisfying an arbitration award. This Checklist addresses pre-award security in arbitrations under the Rules of the Society of Marine Arbitrators, Inc., effective March 14, 2018, including the latest version of the Rules, which applies to contracts entered on or after June 1, 2022.
