In Brookfield Multiplex Constructions LLC v DIFC Investments LLC and another (DIFC CFI 020/2016), the DIFC Court of First Instance considered whether to grant the claimant's application for an anti-suit injunction against the defendants, in circumstances where the first defendant had sought and obtained an order for the appointment of an expert from the non-DIFC Dubai Court despite the existence of an arbitration agreement in the relevant contract.
