Employees often prefer to keep their disabilities private, or they might not have an official diagnosis or even be aware of their disability. Two recent decisions provide interesting lessons for employers on the approach to take to obtaining and relying on advice from occupational health advisers in seeking to avoid claims of disability discrimination.
