This Law Firm Publication by Jackson Lewis P.C. discusses new legislation amending the New York State Human Rights Law (NYSHRL) to protect unpaid interns against workplace discrimination and retaliation. Under the new law, signed by Governor Andrew Cuomo on July 22, 2014, employers are prohibited from discriminating against or harassing based on a protected category or retaliating against an intern for opposing discrimination. Employers also may not produce statements, advertisements, publications or internship applications that discriminate on the basis of a protected category. Finally, under the new law, an employer may not compel a pregnant intern to take a leave of absence. The new law became effective immediately.
