A Practice Note about the use of staffing agencies (also known as labour dispatch agencies) in China. It sets out the principal laws governing labour dispatch arrangements, discusses the use of labour dispatch by representative offices, for whom the arrangement is mandatory, and looks at restrictions on the use of labour dispatch, by entities other than representative offices, such as restrictions on the categories of staff that can be engaged through staffing agencies. The Note also provides some thoughts on how to deal with staffing agencies.
