Commission publishes summary of decision on gas insulated switchgear cartel | Practical Law

On 10 January 2008, the European Commission published in the Official Journal (OJ 2008 C5/7) a summary of its decision to impose fines totalling over EUR750 million on eleven groups of companies for infringing Article 81(1) of the EC Treaty by participating in an illegal collusive tendering cartel in the market for gas insulated switchgear projects between 1988 and 2004 (see Legal update, Commission imposes record fines for gas insulated switchgear cartel). The Commission found that the cartel participants met regularly to allocate projects and agree prices, as a consequence of which they submitted spurious bids for work. There was also an agreement that Japanese and European producers would not compete in each other's territories. Two Opinions of the Advisory Committee and a Report of the Hearing Officer have also been published (OJ 2008 C5/3-6). A number of the companies have lodged appeals against the Commission's decision with the Court of First Instance (Gas insulated switchgear cartel).
