In Home Office v Bailey and others the Court of Appeal has overturned the decision of the employment appeal tribunal and has held that female claimants who sought to compare their pay with that of male employees had raised a prima facie case of indirect discrimination. Accordingly, the Home Office was required to objectively justify the difference in pay.
