In South East Essex College and others v Abegaze the EAT held that a tribunal did not have jurisdiction to consider a claim for post termination discrimination which had been submitted 2 years and 9 months out of time. The tribunal had erred in law by failing to consider the issue of prejudice to the ex-employer and holding that section 27A of the Race Relations Act 1976 applied retrospectively to an act of discrimination which took place before 19 July 2003.
