The High Court in R (Department of Health) v Information Commissioner [2011] EWHC 1430 (Admin), has held that "ground E" abortion statistics are not personal data for the purposes of the Data Protection Act 1998 and, therefore, not exempt from disclosure under the Freedom of Information Act 2000.
