Procedural Arbitrability

The issue, usually determined by the arbitrator, of whether the parties have complied with the terms of the arbitration agreement so that the arbitration may proceed. These terms may include:
  • Time limits for starting the arbitration.
  • Conditions precedent to arbitration, such as a requirement that the parties mediate first.
  • Requirements for a party to give proper notice to the other party.
