New Jersey has enacted a law that restricts access to data recorded by motor vehicle recording devices.
On May 11, 2015, the Governor of New Jersey signed A-3579 into law restricting access to data recorded by motor vehicle recording devices. The law, effective immediately, provides that no one other than the owner of a motor vehicle may have access to the data recorded by a motor vehicle recording device unless the data is accessed:
  • With the owner's consent.
  • With a search warrant.
  • To be used to improve safety or for traffic management.
  • For purposes of servicing the vehicle.
  • By an emergency responder in the event of a motor vehicle crash.
  • In compliance with a discovery request in a civil action.
  • By a subscription service provider pursuant to a subscription service agreement if the agreement discloses that the data may be recorded, stored and transmitted
The law further prohibits disclosure of any accessed data unless the data is disclosed without revealing the identity of the owner or if the owner consents to disclosure and prohibits knowing deletion of data under certain circumstances.
