Developments that may be of interest to arbitration practitioners for the week to 28 October 2015.
We report in brief below on other developments that may be of interest to arbitration practitioners:
  • The Directorate-General for External Policies of the Union has recently published the paper "The investment chapters of the EU's international trade and investment agreements: In a comparative perspective". The paper proposes further coordination between effective domestic legal systems and investor-state dispute settlement (ISDS), as well as the commencement of negotiations to establish a permanent appeals mechanism in a regional or bilateral context.
  • UNCTAD has published its latest Investment Policy Monitor, providing the latest developments in national and international investment policies. During the reporting period, countries concluded seven international investment agreements, including four bilateral investment treaties (BITs), which continue to include ISDS provisions.
  • On 20 October 2015, the Chair of the CIArb European Branch, Laurence Burger, ended a high level strategy briefing with the EU Trade Commissioner, Cecilia Malmström, at which the proposed global investment court was challenged.
